Contacted seller and they said it was new when the got it but would refund me less than the shipping. I had a hunt the next week so I was stuck with it. Come to find out the screw in the ball head was stripped so it wasn’t useable anyways. Got stuck buying a new ball head so I might as well have bought an actual new tripod.
